Actually, getting a record sealing or expunction requires a tricky and sticky process before the judge issues an order for a nasty record to be unavailable for general public access. When conducting Florida Background Check, such information will not be examined such as for employment screen; with exemption to criminal justice agencies, law enforcement and entities working with the children or frail adults. Main thing is the guilty cannot simply run away or hide. Once found guilty, expungement and sealing cannot be issued; chiefly those specified under statute (S. 907.041, F.S.). Crimes of those adjudicated offenders will be included in criminal check data.

In fact, getting a record either sealed or expunged entails many difficult steps before a court releases an order for your record to be sealed or be removed from the records. When conducting Florida Background Check, sealed records will not be detected; except by some authorized agencies e.g. criminal justice, law enforcement and entities dealing with the vulnerable population. Bottom line offenders cannot simply evade the law. Once adjudicated guilty of a criminal offense, record sealing and expunction will not be an option; particularly those under Florida statute S. 907.041, F.S. Criminal records of adjudicated offenders will then become searchable for public reference.
