Will these new regulations usher in an era of “fair” crdit card practices with increased “consumer protection”, or will it simply eliminate the access to credit cards for many riskier borrowers?

Both the government and supporters of this legislation should study the Law of Unintended Consequences. Specifically, they should study the effects of the ATM Fee ban in Santa Monica, when in response, banks were suddenly unwilling to process ATM transactions for non-customers.

When will people learn that seemingly “unfair” practices are almost always backed by economic realities, and that legislation can ban the practice, but it can’t ban economic reality?

Just because a borrower is deemed “riskier” does not necessarily imply that they should be shut off from credit. Instead, interest rates should be allowed to reflect the increased riskiness of that borrower.

Credit Card Billing Disputes Top Among Consumer Credit Card Complaints; Long Island Consumer Attorney Andrew M. Doktofsky Discusses Complaints and Remedies for Consumers

Credit card billing disputes are the most common national consumer complaint, according to a consumer response report published in November 2011 by the Consumer Financial Protection Bureau, which is a U.S. governmental agency that enforces federal consumer financial laws.

The Consumer Financial Protection Bureau (CFPB) collected various credit card-related complaints from consumers over a three-month period and analyzed and how they were handled by credit card companies. Doktofsky, a billing dispute lawyer in Long Island, The Fair Credit Billing Act provides a remedy for consumers who have disputes associated with open-end credit, including credit card companies. The FCBA covers a variety of consumer billing disputes. Once an individual gives the creditor timely notice of a billing error, the creditor is not permitted to take any action to collect the disputed amount from the consumer, until the creditor conducts a reasonable investigation of the billing error. Further, the creditor cannot report the consumer as delinquent, or threaten the consumers credit rating, pending resolution of the disputed amount.

Business Credit Card: Small Companies

When you own a small business you are, undoubtedly, going to use a credit card for some of your purchases. What all business owners need to keep in mind is that these cards do not offer the same protections that personal credit cards offer. First and foremost, these cards do not have the same identity theft protection features that other cards include. If someone makes unauthorized charges to the card the business is still responsible for the amount. There is no consumer protection attached to these cards. You must be very careful when using them. Interest rates and fee limitations are not controlled on these cards like a personal card. You can not contest a spike in your interest or increase in fees like a personal card. Business credit cards have not been included in this legislation. Finally, if you should have trouble with any representative from the company regarding payment or processing of your cards, you do not have consumer protection. The FTC does not offer any protection from unfair trade practices to a business credit holder. If you are a small business, it is in your best interest to have a personal card that you use strictly for business purposes. If you designate a card in this fashion you will be given the FTC protections and still have the tax credits for your business expenses. The trick is to only use the card for your business and nothing personal – ever. This keeps your books straight and your receipts in order for tax time.
