Get a TOP lawyer in that field and consult to see if you have a case.
i would imagine your first step would be to talk to a lawyer to see if you have a case
file in civil court
Good luck.. If you are lucky your case will be heard by 2011.
You give very few details….obviously the easiest is to talk to an attorney and pay him to do it for you….he’ll also give you the lowdown on the strength of your case…
The other is to go ahead and file the complaint yourself…”pro se.”
In some states, you must file a motion to request to file a complaint pro se….for many states don’t want somebody who knows nothing about law…..wasting the courts time……So, you may have to do that depending upon where you live..
But generally to file, You file the complaint with the appropriate court and you send a copy with summons to the company you’re suing….going through the sheriff makes it a lot easier to serve the complaint (for it proves they got it)…anyway, it gets very complex from there…but I encourage all to “go for it.”
I would get a legal plan with ID theft protection from a company that specializes in this type of thing. Your lawsuit probably won’y be covered by the plan but you will get a discount and most of all advice from a company that is an expert in this field. Here is a link to the legal and ID theft plan I have: There is a law that covers how companies are required to safeguard your info called ADRS and this company seems to be best out there in this area. Don’t delay taking action on this because there are deadlines for taking care of it.
I hope this helps, take care!
